UNDERSTANDING EXPUNGEMENT



LEARN THE BASICS OF THE LAW


An expungement proceeding is a civil matter filed in the Superior Court of New Jersey in which a person seeks to have a record of a prior criminal conviction expunged. If you're successful, the expungement seals the record, making it invisible from most government databases. This means that when someone does a background check on you, their search will turn up, “No record found.” Additionally, this gives you the legal right to state, even under oath, that the arrest or conviction never occurred.


An expungement is not the same as a pardon. An expungement entitles the petitioner who receives it to treat the offenses as though they never occurred. A pardon meanwhile, doesn’t erase the event. It simply means that you are forgiven for the offenses.


While an expungement eliminates the need to disclose your arrest or conviction in most situations, there are a few basic exceptions. These include applying for employment with law enforcement agencies and the judicial system, and applying for a professional license.



WHO IS ELIGIBLE FOR AN EXPUNGEMENT IN NEW JERSEY?


Eligibility for an expungement of an arrest or conviction is found in New Jersey law if the criminal record is based on offenses committed in New Jersey. Numerous requirements and conditions must be adhered to before you can file for an expungement. Such requirements include:


  • Waiting the required period of time before filing for the expungement, based
       on the offense committed
  • No intervening incidents
  • No more than a specified number of prior offenses
  • No serious prior convictions
  • All conditions of sentence and/or probation have been completed
  • No pending criminal proceedings

There are also certain convictions which one is forbidden from having expunged from there record. These include:
 

  • Felonies and first-degree misdemeanors where the victim is a minor;
  • Rape;
  • Sexual Battery;
  • Corruption of a minor;
  • Sexual imposition;
  • Obscenity or pornography involving a minor
